What are digital signings?

Remote online notarization is the act of performing a notarization remotely using two-way audio-video technology. It is the online equivalent of an in-person, paper-based notarization where every part of the process is done via the Internet.

 

Virtually any document that can be notarized in person can be notarized remotely, but there are a few

exceptions:

  • Self-proving Wills and codicils.

  • Non-Self Proving Wills and codicils to be used in states other than Florida or Nevada.

  • Testamentary Trusts and any amendments to Trusts, and Inter-Vivos Trusts to be used in states other than Florida or Nevada.

  • I-9 Forms.

  • Certified true copies of birth, marriage, or death certificates, or court-issued documents.

  • Documents intended for use outside the United States.

  • Documents in which the notary is named or has a beneficial interest.

  • Documents containing pictures of children.

 

A hybrid closing is a type of digital closing where some of the loan package is signed or notarized in ink and the rest is electronically completed. The lender or investor’s preferences dictate which documents are wet-signed versus eSigned.


Borrowers receive the digitized closing package as soon as it’s ready. This allows them to review it, ask questions, and eSign some of the documents before the closing appointment. At the in-person closing, borrowers wet sign the papers that need to be executed in ink.


The most common type of hybrid closing is: A hybrid closing that includes eSigning non-notarized documents, a paper note or eNote, ink notarization, and an in-person closing appointment.

The term “eSigning” is a legally binding method by which you can obtain or give consent to a digital document such as a PDF, similar to a paper signature. Like handwritten signatures, qualified electronic signatures are unique for each person and therefore forgery-proof. In general, eSigning can be used for all contracts, offers, and other documents between two or more contractual partners.


To ensure the validity of the signers, we use a multi-factor authentication process which includes knowledge based questions that only your signer will know. This allows us to be certain that the correct person is at the signing with our notary.
